Is There a Dispensary in Amagansett? No, and Here Is Where Adults Buy Instead

East Hampton Town opted out of cannabis retail in 2021, so Amagansett, Napeague and Montauk have no licensed storefront. The nearest stores, how delivery works, and what the state-land rule means out east.

Search "marijuana dispensary Amagansett" and the results suggest a shop around the corner from Main Street. There isn't one. Amagansett, Napeague, Springs, Wainscott, East Hampton and Montauk all sit inside the Town of East Hampton, and the town opted out of hosting licensed cannabis dispensaries before the state's 2021 deadline. Adults 21+ in Amagansett still have two legal routes: a 15-to-20-minute drive west to the licensed stores in Water Mill and Southampton, or licensed delivery to the house.

Why there is no dispensary in Amagansett

New York's cannabis law gave every city, town and village until December 31, 2021 to opt out of retail dispensaries, on-site consumption lounges, or both. The East Hampton Town Board voted unanimously on December 2, 2021 to opt out of both. Town officials said at the time they might allow sales later, once zoning rules were written. As of 2026, no repeal has passed, so no retail license can be issued anywhere in the town, Amagansett and Napeague included.

The question has not gone away. A resident started a petition in early 2025 asking the board to allow regulated dispensaries, and the town said the board would review it once submitted. Under state law a town that opted out can opt back in at any time by repealing its local law. Until that happens, the storefront map east of Wainscott stays blank.

The Village of East Hampton opted out separately, as did Sag Harbor. The Town of Southampton opted in, which is why every licensed South Fork storefront sits west of the town line.

Where adults 21+ in Amagansett can buy

The nearest licensed stores are in Water Mill and along County Road 39 in Southampton. As of 2026 that list includes Hampton Premium Green at 978 Montauk Highway in Water Mill, set in a restored farmhouse, and three shops on the County Road 39 corridor: Charlie Fox, The Hamptons Collective and Brown Budda New York. Hampton Premium Green puts the drive from Amagansett at roughly 10 to 12 miles, 15 to 20 minutes west on Montauk Highway in normal conditions and a good deal longer on a summer Friday.

Hours change with the season, so check each store's own site before the drive. The dispensary directory carries current listings.

Opting out stopped storefronts, not deliveries. The Office of Cannabis Management's delivery FAQ is explicit: licensed dispensaries can deliver to adults 21+ at residential properties, short- and long-term rentals included, and to private businesses anywhere in New York State. Several of the Southampton and Water Mill stores advertise same-day delivery to Amagansett's 11930 ZIP code, Springs and Montauk.

The rules that come with it:

  • Prepaid only. Orders are paid online or by phone when placed. Cash is not accepted at the door.
  • ID and signature at handoff. The courier checks a valid government photo ID showing 21+ and collects a signature. If someone else will answer the door, the person ordering must attest that they are 21+, and they still show ID.
  • No deliveries to cars, beaches or parks. Deliveries cannot go to a motor vehicle, a public space, a park or a public building. A parking lot at Atlantic Avenue Beach does not qualify.
  • Store hours apply. Delivery runs only during the dispensary's hours of operation, so a late order on a Saturday in August may roll to the next window.

Verify before you buy

Smoke shops and vape stores in East Hampton Town are not state-licensed cannabis retailers, whatever the window signs suggest, because the town cannot host one. Verify licensed status via the OCM QR code at cannabis.ny.gov before buying from any store, and check that a delivery service is tied to a licensed dispensary. Regulated products carry the state's universal symbol on the package, plus a QR code that links to the lab's certificate of analysis.

The shops on Shinnecock Nation territory near Shinnecock Hills operate under the Nation's own authority, not a New York State license, so they do not show an OCM code. That is a jurisdictional distinction rather than a verdict on quality.

The Napeague stretch and the state-land rule

Napeague is the low, sandy isthmus between Amagansett and Montauk, and much of it is public land. The Walking Dunes trail in Hither Hills State Park, reached from the end of Napeague Harbor Road, is a short loop over parabolic dunes that migrate a few inches a year and have uncovered a buried "phantom forest" along the way. It is one of the better off-season walks on the South Fork.

It is also state-owned land. New York state law prohibits cannabis consumption on state-owned land and in public spaces, which covers Hither Hills, Napeague State Park, the town beaches and the parking lots beside them. Consumption in a vehicle is prohibited too, for drivers and passengers. The realistic setting is a private residence where the lease allows it, and plenty of East End rental agreements do not.

What to know before ordering to a rental

  • Read the lease. Many Amagansett and Montauk rentals ban smoking indoors and out. Edibles and sealed purchases are a different matter from a cleaning-fee violation.
  • Know the limits. Adults 21+ can possess up to 3 ounces of cannabis and up to 24 grams of concentrated cannabis, a category that covers edibles, oils and vapes.
  • Start low, go slow. Edibles take time to register, and a first night out east is the wrong moment to find that out. Begin with a low-milligram serving and wait before taking more.
  • Keep it in New York. Carrying cannabis across a state line, onto the Cross Sound Ferry to Connecticut, or onto a flight moves it into federal jurisdiction, where it remains illegal.

The short version

Amagansett has no dispensary because East Hampton Town opted out in 2021 and has not opted back in.
